In any purchases made by minors, the JUNTA CONSTRUCTORA shall not be responsible for the validity of the consent granted to enter into this binding agreement nor the need for their legal representatives to give permission for said action. Furthermore, the JUNTA CONSTRUCTORA shall not be liable for verifying the accuracy or truthfulness of the details provided by Users. Therefore, the JUNTA CONSTRUCTORA shall not be liable for individuals who are found in breach of their obligation to provide their own, truthful, accurate and legal information, as said individuals shall be solely responsible for any consequences that may arise from false or inaccurate details provided, as well as any damages said actions may cause to the JUNTA CONSTRUCTORA or third parties.

3.9.    The JUNTA CONSTRUCTORA shall not accept any Tickets purchased through resale agents.

4.    Non-transferable use and prohibition on reselling Tickets

4.1.    Under no circumstances may Tickets be purchased through the Website for purposes other than those expressly established in these conditions.

4.2.    In this regard, and to avoid the resale of Tickets under conditions that are detrimental to visitors to the Temple and/or Gaudí House Museum, Users may not resell the Tickets at any price nor undertake any reciprocal legal action to transfer use or ownership of the Tickets to a third party. Nor may guides purchase Individual tickets for the purpose of reselling them to third parties. Only official distributors and collaborators expressly authorised by the JUNTA CONSTRUCTORA may make Tickets acquired previously available to third parties, always in the strictest compliance, under all circumstances, with the conditions agreed upon with the JUNTA CONSTRUCTORA in advance.

4.3.    In the case of any resale or reciprocal transfer of the use or ownership of a Ticket to a third party, the JUNTA CONSTRUCTORA shall have the right to: (i) cancel the Ticket without reimbursing the User in any way; (ii) block access to the Temple and/or Gaudí House Museum to the third party holding or owning any Ticket that has been resold or reciprocally transferred; (iii) sue the User for any damages arising from the resale of the Ticket or the reciprocal transfer of its use or ownership. The JUNTA CONSTRUCTORA shall pursue any behaviours that infringe on the content of this clause to the fullest extent of the law, both in and out of court.

4.4.    Purchasing a Ticket does not give the User the right to use it for any advertising, promotional or marketing purposes (including but not limited to contests, promotions, gifts or draws) without the express prior consent of the JUNTA CONSTRUCTORA.

4.5.    Furthermore, it is expressly prohibited to install the information and contents of the Website on any terminal or sever connected directly or indirectly to the Internet or a local network that gives third parties access to said contents by any means other than the Website. The JUNTA CONSTRUCTORA reserves the right to block from the Website any Users that have used (or are suspected of using) the Website improperly or fraudulently.

4.6.    The JUNTA CONSTRUCTORA shall only be responsible for Tickets purchased through the Website.

5.    Changes and returns policy

5.1.    As a general rule, once the Tickets have been acquired by the User, the JUNTA CONSTRUCTORA shall not allow any changes or returns. Furthermore, Users that are consumers may not exercise their right to withdraw from the purchase contract established in Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users, as the Tickets pertain to a recreational service to take place at a specific date and time.

5.2.    As an exception to the general rule above, Users may only request to exchange or return Tickets that have not been used, at their behest and in accordance with the provisions of the following conditions, when the User is not able to visit the Temple and/or Gaudí House Museum (or not able to do so in the conditions and with additional services acquired with the Ticket) due to some sort of incident: (i) regarding access to the premises; (ii) that impedes the User or any other User in the same condition from accessing the premises (for example, if there is an event at the Temple that was not foreseen sufficiently in advance and the Temple must be closed to visitors); (iii) that is not attributable to the User or third parties not associated with the JUNTA CONSTRUCTORA (for example, weather incidents); and (iv) when they provide official proof of the reason they are not able to visit. If Users cannot make use of the additional services purchased for reasons attributable to the JUNTA CONSTRUCTORA, they shall be reimbursed for these services, however Users may not claim reimbursement for services used or for entry to the Temple and/or Gaudí House Museum.

5.3.    If the circumstances in condition 5.2 above were to occur, Users may request the Tickets be exchanged, requesting the date and time for the new Tickets, which shall have the same characteristics, mode and services and the original ones. Tickets must be exchanged within fifteen (15) days of the originally scheduled visit to the Temple and/or Gaudí House Museum, as indicated on the original Ticket. Requests for exchanges must be sent to customer@ext.sagradafamilia.org. Nevertheless, the request shall be subject to Ticket availability and the authorisation in each specific case of the new date and time chosen by the User. Users will not be charged for exchanging Tickets. Users may also exchange Tickets at the ticket offices at the Temple and/or Gaudí House Museum, as long as capacity allows the visitor to enter the Temple on that same day. The JUNTA CONSTRUCTORA shall only allow changes to Tickets purchased through the Website that have not expired.

5.4.    If the circumstances in condition 5.2 above were to occur, Users may alternatively choose to return and be refunded for their Tickets. The refund process for Tickets is as follows: To request the return and refund of Tickets purchased through the Website, Users must submit the Tickets in digital or paper format, along with the booking code, within fifteen (15) days of the date on the original Ticket. Requests for refunds must be sent to customer@ext.sagradafamilia.org. If services are unavailable and/or the Temple and/or Gaudí House Museum is closed by decision of the organiser, refunds will be made automatically via the original payment method and ticket holders will not have to submit their tickets. Ticket refunds will only be made to the User who bought the tickets. If the reason for returning the Tickets is that it was not possible to enter one of the premises or use any of the additional services purchased, only the proportional amount corresponding to the premises or services affected shall be refunded, according to prices on the Website at any given time. Tickets will be refunded through the original payment method. The deadline for processing refunds will be thirty (30) days from the date the request was made. If the purchase was made with a credit or debit card, the refund period will depend on each User’s bank. The User will only be refunded the amount they paid for the Tickets. Under no circumstances shall the User be refunded for any other costs or expenditures, including but not limited to transport and accommodations.

5.5.    The JUNTA CONSTRUCTORA shall not manage and/or authorise exchanges or returns of Tickets purchased through unofficial intermediaries or distributors, and said issues must be taken up with these third parties in accordance with their conditions.

6.3.    Users shall be solely responsible to the JUNTA CONSTRUCTORA and third parties for any infringement on the intellectual, industrial or similar property rights to the Website, Temple, Gaudí House Museum or any of their elements or contents.

11.10.    With regard to the Personal Data needed to respond to queries made by the User, and to send electronic commercial communications, it shall be kept as long as the User does not revoke the consent granted and, if consent is revoked, for the period necessary to comply with any obligations that may have arisen.
